Class Actions
Class actions are a special type of legal proceedings in which a large group of individuals collectively sue another party, usually an insurance company, corporation, or government entity. The frequent goal is to seek substantial compensation (often in the millions) for damages suffered by the group. Requirements for class actions include: a large number of individuals who have similar claims against the defendant, the claims must be too numerous to pursue individually, the claims must raise common questions of law or fact, the named plaintiff must be typical of the class and must have been injured by the same conduct and the named plaintiff must be able to adequately represent the interests of the entire class. There are limitations to class actions including: the right to sue must be timely and the statute of limitations must not have expired, the class must be defined clearly and concisely, the court must have jurisdiction over the defendant, and the class action must be superior to other methods of resolving the dispute. Not all group claims get certified as a class action.
